The Nurse | KOLLATERAL
After her second vaccination with BioNTech Pfizer she was admitted to hospital. The diagnosis: paralysis of one side of the body, inflammation of the brain, autoimmune disease. Six stays in hospital within one year follow. Dismissal by her employer. Incapacity for work. She has only one hope left: her lawyer.
The vaccination changed everything. The vaccination that was supposed to protect me from a severe course of corona. It backfired enormously. It brought me more grief and suffering than protection. I was dismissed, because they had seen it: I was in hospital for a week after the second vaccination. They then saw that I was not getting well that quickly, because it is something bigger after all.
And what is galling is that you cannot help it. You had yourself vaccinated in good faith. Because the vaccination took place at the workplace, it was organised by the employer. We were somehow stopped in passing: read this through here, sign here. How are you supposed to ask your employer, who is not a doctor at all, about any side effects, when she cannot answer that for you? Yes, definitely, yes. Then came the dismissal. Here.
Pre-existing condition, vaccine reaction. Vaccine reaction. Vaccine reaction. The clinic, my second home. Clinic. Here it was reasonably all right. That was again after a flare-up, after the recovery phase, before the second one, the next one, came. Clinic. Clinic. During that … antibody treatment. At home. That is bad. And this is a picture where I had another flare-up.
That I look ten years older. That is a difference of just one year. Thirteen months. That is really something. But I cannot name it. My experience from last year is that the doctors ... I already had that last year in February. Experienced it in my own body.
That doctors do not want anything to do with cases like these. They do not want to come into contact with it. And you simply notice that. In the ... fear, perhaps. Or ... that they do not know how to go on. Or that they do not want to get involved in such a thing at all. Because we know, vaccine stories are hard to prove. Yes. And I believe many doctors are afraid of burning their fingers there. In order to help a patient. Yes. That was my experience from last year. Yesterday I looked at that business with your employer.
I found it particularly outrageous. I had another look at your marks, Mrs Ferati. There, erm ... what marks you had in your training. I have it right here. Theory 1.1, practice 1.25. Final mark, personal competence 1.2. Mhm. Shows a great deal of interest and activity at work. And then the final mark, professional competence 1.1. Is goal-oriented, can use the technical language very well in accordance with the stage of training. And finally 1.1 as well, final mark, social competence. So, and the last one, as I said, theory 1.1, practice 1.25.
The letter is dated the 11th of March. The termination of the employment followed on the 23rd of March, so not even 14 days later. We justify the decision by saying that we can no longer see a trusting and constructive cooperation. And regard the employment relationship as severely damaged. Yes, erm ... I did swallow hard back then, and in fact again yesterday, when I looked at the documents. What a blatant contradiction that is. That means they simply took the fact that you fell ill because of the vaccination as an occasion, one can say, to drop you, in order to say: the employment relationship is severely damaged.
Constructive cooperation is no longer possible. And that with the marks you had until then, well ... Yes, you do have to swallow hard when you read that. Before I started the training I was also employed there as a care assistant. Erm, six, seven months. And if there had been some deficit in my person, it would never have come to the training, to my starting the training. But I was no longer of use, because my health was damaged. In such a case I would have expected it of the employer, especially as the vaccination happened at his urging, at his instigation, that he would stand behind her and say: okay, Mrs Ferati has fallen ill, we will support her by every means available to us.
That would be what I would have expected of the employer. Instead she was really, one can say, dropped like a hot potato. At the time we of course immediately filed an unfair dismissal claim at the competent labour court. The only problem was that the dismissal had come, I believe, one day before the end of the probation period. That means we could not fight the dismissal itself. So what we could achieve in court was that Mrs Ferati at least got a good reference. That means we made it clear that it was not as set out in the dismissal, employment relationship severely damaged and no constructive cooperation possible any more. She really did get a good reference, with a good assessment of performance and conduct, and she also received a decent severance payment.
But the dismissal itself we could not fight, since it had come within the probation period. Besides, it would not have helped her either if the dismissal had come only after the probation period. Why? She was no longer able to work, the poor woman. That means, even if we had somehow managed to keep the employment relationship going. Sadly she is still signed off sick and unfit for work to this day, so it would not have helped at all. That is the sad thing about it. I am then, for the employer — the judge said that too — humanly … do you remember? The judge really was very, very human. In human terms it is the lowest, but the employer thinks economically.
You can see, she said that too, this woman's performance, it was outstanding. And from that you can already tell why the dismissal came. Because I am ill and nobody can expect in the near future, that it is simply because of the employer's economic thinking. And that is why I was sorted out. The judge said that at the time as well. But you do have to give some reason. He could not write anything in there. Yes, we are dismissing you now because you have fallen ill? And we do not know how long you will need to get well. I assume that it was not only economic considerations, but that Mrs Ferati was, as I see the matter in hindsight, simply not good advertising — advertising in quotation marks. The employer had pushed massively for the vaccination.
Of course, working in a care home, that is understandable too. And if somebody then becomes seriously ill because of the vaccination and is completely unfit for work for the foreseeable future, well of course, that simply caused unrest in the business. And he wanted to sweep that under the carpet. That is clear, because the longer Mrs Ferati had stayed in the business, the higher the waves it would have made. And the employer simply did not want that. He wanted to remove the problem. That is how it is. Although I was not the only one who had complaints after the second vaccination. Another colleague was ill for two or three weeks straight after the second vaccination. Another colleague was also off for one or two weeks after the vaccination. So I was the third in that group. But unfortunately I took the prize with my complaints.
It was not the case that it was two or three weeks of aching limbs and fever and exhaustion on top. Perhaps one more word about the employer. After the whole thing was settled at the labour court, severance payment, a proper reference, I thought: now it has been concluded quite decently after all. And then the employer went and kicked her again. You may remember: at the team meeting it was then spread, in front of the assembled staff, that Mrs Ferati has a mental disorder. Yes, and I found that very, very ugly again: that after the dismissal was through anyway — it was clear Mrs Ferati would not work there any more — she was then kicked again and ...
yes, dragged through the mud. And at the time we wanted to take action against that too. The only problem was that the only witness who had seen the whole thing, that a massive damage to Mrs Ferati's reputation had taken place here, she worked there too and did not want to testify as a witness in court. That means we simply had no evidence. Otherwise it would have been my urgent advice, also from a psychological point of view for Mrs Ferati, to fight it, after her reputation really had been massively damaged afterwards, completely unnecessarily. Mrs Ferati has a mental disorder. But he had to justify it somehow, because people know: I was friendly — I can prove it — I worked properly, I was reliable.
Nothing spoke against me at that workplace. And when a dismissal is then handed out because somebody has fallen ill from a vaccination, you have to justify it somehow to the other staff. They had even worked closely with me. Yes, so what do you do? She has psychosomatic problems, that is why she has the complaints. Otherwise there is nothing wrong with her. We are now also asserting claims against the vaccinating doctor, who had not informed Mrs Ferati in the slightest about possible risks that could be connected with the vaccination. Very briefly, what has to be explained: countless circumstances, that it is only a conditional authorisation, that the trial phase was only very, very short, an explanation of the course of treatment, of treatment alternatives, and, and, and. So an awful lot of circumstances have to be explained.
In our case it was like this: no information was given at all. In human terms, too, I found it sad that the vaccinating doctor did not even get in touch with Mrs Ferati and at least apologise for what had happened. Of course she would never ever have had herself vaccinated if she had known all the things that can be connected with the vaccination. Instead it was claimed afterwards that Mrs Ferati had waived any explanation. Now they are trying to talk their way out of it with that. I find that very, very sad, in human terms too. That is why we will file a claim against the vaccinating doctor very shortly, at the competent regional court in Heilbronn.
We will claim damages for pain and suffering. The decisive problem, however, lies somewhere else entirely. I would like to go into that very briefly, and it applies to claims against the state as well. We already explained it earlier, with the burden of proof. We have to prove that the vaccination led to the damage. That means that no other circumstances were the cause. And there have already been cases in the case law where the patient died one hour after the vaccination. And it was then objected in the proceedings: well, the vaccination was not causal, it was other circumstances that caused the death. What is good, of course, very, very good, is that Mrs Ferati went to the SLK clinic immediately the next day and reported the complaints at once, so that the corresponding medical report was drawn up as well.
Unfortunately that still does not mean that proof has been provided that the vaccination really led to the damage. No, here too the court will then appoint an expert. And it is then up to the expert to produce a corresponding opinion, which will hopefully show that the vaccination caused the damage. But that is where, in the proceedings coming up shortly, the main problem lies, the central point: that the burden of proof unfortunately lies with us, that we have to prove that the vaccination led to the damage. The thing is, after six months the whole thing is recognised as vaccine damage. After Mrs Ferati showed these massive symptoms here, we acted immediately and reported the whole thing to the pensions office beforehand, before the six months had run out, so as not to be exposed later to the accusation of having slept on it.
Yes, and the problem was that ... it was in November, so about nine months after the vaccination, a letter then came from the pensions office, yes ... Dear Mr Lawyer, we are terribly sorry. At present we have no experts who can assess the whole thing seriously, whether the damage in Mrs Ferati's case can really be traced back to the vaccination. That means the pensions office simply said: our hands are tied, we have no way of establishing a causal connection here between vaccination and the damage that occurred, because we still lack the scientific findings. That was of course the next slap in the face for Mrs Ferati. When everywhere it is said: the vaccination is safe, the vaccination is safe.
Theorie 1,1, Praxis 1,25. Endnote, Personalkompetenz 1,2. Mhm.
Ja, was macht man da?

Ja, was macht man da?
