Relevant legal bases

Below you will find an overview of the legal bases of the GDPR on which we process personal data. Please note that, in addition to the provisions of the GDPR, national data protection provisions may apply in your or our country of residence or establishment. Should more specific legal bases be relevant in individual cases, we will inform you of these in this privacy policy.

  • Consent (Art. 6(1)(a) GDPR) – The data subject has given consent to the processing of his or her personal data for one or more specific purposes.
  • Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR) – Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
  • Legal obligation (Art. 6(1)(c) GDPR) – Processing is necessary for compliance with a legal obligation to which the controller is subject.
  • Legitimate interests (Art. 6(1)(f) GDPR) – Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

In addition to the data protection provisions of the General Data Protection Regulation, national data protection regulations apply in Germany. These include in particular the Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG). The BDSG contains in particular special provisions on the right of access, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes and transmission, as well as automated decision-making in individual cases, including profiling. It also regulates data processing for employment purposes (Section 26 BDSG), in particular with regard to the establishment, performance or termination of employment relationships and the consent of employees. Furthermore, the data protection laws of the individual German federal states may apply.

Security measures

In accordance with the legal requirements and taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, we take appropriate technical and organisational measures to ensure a level of protection appropriate to the risk.

These measures include in particular safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as access to, input, disclosure, assurance of availability and separation of the data. Furthermore, we have established procedures to ensure that data subjects’ rights are exercised, data is deleted and responses are made to threats to the data. We also take the protection of personal data into account when developing or selecting hardware, software and processes in accordance with the principle of data protection by design and by default.

TLS encryption (https): To protect your data transmitted via our online offer, we use TLS encryption. You can recognise such encrypted connections by the prefix https:// in the address bar of your browser.

Transfer of personal data

In the course of our processing of personal data, the data may be transferred to or disclosed to other bodies, companies, legally independent organisational units or persons. Recipients of this data may include, for example, service providers commissioned with IT tasks or providers of services and content that are integrated into a website. In such cases, we observe the legal requirements and in particular conclude appropriate contracts or agreements with the recipients of your data that serve to protect your data.

Data transfer within the organisation: We may transfer personal data to other bodies within our organisation or grant them access to this data. Where this transfer is for administrative purposes, it is based on our legitimate business and commercial interests, or it takes place where it is necessary to fulfil our contractual obligations or where the data subjects have given their consent or there is a legal permission.

Data processing in third countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if processing takes place in the context of using third-party services or disclosing or transferring data to other persons, bodies or companies, this is only done in accordance with the legal requirements.

Subject to express consent or a transfer required by contract or law, we process or have data processed only in third countries with a recognised level of data protection, on the basis of contractual obligations through so-called standard contractual clauses of the EU Commission, where certifications exist or on the basis of binding corporate rules (Art. 44 to 49 GDPR, information page of the EU Commission: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection_en).

Erasure of data

The data processed by us will be deleted in accordance with the legal requirements as soon as the consents permitting its processing are withdrawn or other permissions cease to apply (e.g. if the purpose of processing this data no longer applies or the data is not required for that purpose). If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted to these purposes. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons or whose storage is necessary for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person.

Within our privacy notices, we may provide users with further information on the deletion and retention of data that applies specifically to the respective processing operations.

Use of cookies

Cookies are small text files or other storage notes that store information on end devices and read information from end devices, for example to store the login status in a user account, the contents of a shopping basket in an online shop, the content accessed or functions used in an online offer. Cookies can also be used for various purposes, e.g. for the functionality, security and convenience of online offers and for analysing visitor flows.

Notes on consent: We use cookies in accordance with the statutory provisions. We therefore obtain prior consent from users, except where this is not required by law. Consent is not required in particular if storing and reading information, including cookies, is strictly necessary to provide users with a telemedia service (i.e. our online offer) that they have expressly requested. The revocable consent is clearly communicated to users and contains information on the respective use of cookies.

Notes on legal bases under data protection law: The legal basis under data protection law on which we process users’ personal data with the help of cookies depends on whether we ask users for consent. If users consent, the legal basis for processing your data is the declared consent. Otherwise, the data processed with the help of cookies is processed on the basis of our legitimate interests (e.g. in the business operation of our online offer and improving its usability) or, if this takes place in the context of fulfilling our contractual obligations, if the use of cookies is necessary to fulfil our contractual obligations. We explain the purposes for which we process cookies in the course of this privacy policy or as part of our consent and processing procedures.

Storage period: With regard to the storage period, a distinction is made between the following types of cookies:

  • Temporary cookies (also: session cookies): Temporary cookies are deleted at the latest after a user has left an online offer and closed their end device (e.g. browser or mobile application).
  • Permanent cookies: Permanent cookies remain stored even after the end device has been closed. For example, the login status can be saved or preferred content can be displayed directly when the user visits a website again. Likewise, user data collected with the help of cookies can be used for reach measurement. If we do not provide users with explicit information on the type and storage period of cookies (e.g. when obtaining consent), users should assume that cookies are permanent and that the storage period can be up to two years.

General information on withdrawal and objection (opt-out): Users can withdraw the consents they have given at any time and also object to processing in accordance with the legal requirements of Art. 21 GDPR. Users can also declare their objection via the settings of their browser, e.g. by deactivating the use of cookies (which may also restrict the functionality of our online services). An objection to the use of cookies for online marketing purposes can also be declared via the websites https://optout.aboutads.info and https://www.youronlinechoices.com/ .

Further information on processing operations, procedures and services:

  • Processing of cookie data on the basis of consent: We use a cookie consent management procedure in which users’ consent to the use of cookies, or to the processing operations and providers named in the cookie consent management procedure, is obtained and can be managed and withdrawn by users. The declaration of consent is stored so that it does not have to be requested again and so that consent can be proven in accordance with the legal obligation. Storage can take place on the server side and/or in a cookie (so-called opt-in cookie, or using comparable technologies) in order to be able to assign the consent to a user or their device. Subject to individual information on the providers of cookie management services, the following applies: consent may be stored for up to two years. A pseudonymous user identifier is created and stored together with the time of consent, information on the scope of the consent (e.g. which categories of cookies and/or service providers) and the browser, system and end device used.
  • Complianz: Cookie consent management; Service provider: Hosted locally on our server, no data transfer to third parties; Website: https://complianz.io/; Privacy policy: https://complianz.io/legal/; Further information: An individual user ID, language and types of consent as well as the time they were given are stored on the server and in a cookie on the user’s device.

Business services

We process data of our contractual and business partners, e.g. customers and prospective customers (collectively referred to as “contractual partners”), in the context of contractual and comparable legal relationships and related measures and in the context of communication with contractual partners (or pre-contractually), e.g. to answer enquiries.

We process this data in order to fulfil our contractual obligations. These include in particular the obligations to provide the agreed services, any update obligations and remedies in the event of warranty claims and other performance disruptions. In addition, we process the data to safeguard our rights and for the purpose of the administrative tasks associated with these obligations and of business organisation. Furthermore, we process the data on the basis of our legitimate interests in proper and economic business management and in security measures to protect our contractual partners and our business operations from misuse and from risks to their data, secrets, information and rights (e.g. for the involvement of telecommunications, transport and other auxiliary services as well as subcontractors, banks, tax and legal advisors, payment service providers or tax authorities). Within the framework of applicable law, we only pass on the data of contractual partners to third parties to the extent that this is necessary for the aforementioned purposes or to fulfil legal obligations. Contractual partners are informed about other forms of processing, e.g. for marketing purposes, within the framework of this privacy policy.

We inform contractual partners which data is required for the aforementioned purposes before or during data collection, e.g. in online forms, by special marking (e.g. colours) or symbols (e.g. asterisks or similar), or in person.

We delete the data after expiry of statutory warranty and comparable obligations, i.e. in principle after 4 years, unless the data is stored in a customer account, e.g. as long as it must be retained for legal archiving reasons. The statutory retention period for documents relevant to tax law and for trading books, inventories, opening balance sheets, annual financial statements, the working instructions and other organisational documents required to understand these documents and accounting vouchers is ten years, and for commercial and business letters received and copies of commercial and business letters sent it is six years. The period begins at the end of the calendar year in which the last entry was made in the book, the inventory, the opening balance sheet, the annual financial statements or the management report were drawn up, the commercial or business letter was received or sent or the accounting voucher was created, and furthermore the record was made or the other documents were created.

Insofar as we use third-party providers or platforms to provide our services, the terms and conditions and privacy notices of the respective third-party providers or platforms apply in the relationship between the users and the providers.

  • Types of data processed: Inventory data (e.g. names, addresses); payment data (e.g. bank details, invoices, payment history); contact data (e.g. email, telephone numbers); contract data (e.g. subject matter of the contract, term, customer category); usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Customers; prospective customers; business and contractual partners.
  • Purposes of processing: Provision of contractual services and customer service; security measures; contact requests and communication; office and organisational procedures; managing and responding to enquiries; conversion measurement (measuring the effectiveness of marketing measures); profiles with user-related information (creating user profiles).
  • Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR); legal obligation (Art. 6(1)(c) GDPR); legitimate interests (Art. 6(1)(f) GDPR).

Further information on processing operations, procedures and services:

  • Customer account: Contractual partners can create an account within our online offer (e.g. customer or user account, “customer account” for short). If the registration of a customer account is required, contractual partners will be informed of this as well as of the information required for registration. Customer accounts are not public and cannot be indexed by search engines. In the course of registration and subsequent logins and use of the customer account, we store customers’ IP addresses together with the access times in order to be able to prove the registration and prevent any misuse of the customer account. If customers have terminated their customer account, the data relating to the customer account will be deleted unless its retention is required for legal reasons. It is the customers’ responsibility to back up their data when terminating the customer account; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • Watch list / wish list: Customers can create a product or wish list. In this case, the products are stored in the course of fulfilling our contractual obligations until the account is deleted, unless the product list entries are removed by the customer or we expressly inform the customer of different storage periods; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • Economic analyses and market research: For business reasons and in order to identify market trends and the wishes of contractual partners and users, we analyse the data available to us on business transactions, contracts, enquiries, etc., whereby the group of data subjects may include contractual partners, prospective customers, customers, visitors and users of our online offer. The analyses are carried out for the purpose of business evaluations, marketing and market research (e.g. to determine customer groups with different characteristics). In doing so, we may take into account the profiles of registered users, if available, including their information, e.g. on services used. The analyses are for our use only and are not disclosed externally unless they are anonymous analyses with aggregated, i.e. anonymised, values. Furthermore, we take the privacy of users into account and process the data for analysis purposes as pseudonymously as possible and, where feasible, anonymously (e.g. as aggregated data); Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).
  • Shop and e-commerce: We process our customers’ data in order to enable them to select, purchase or order the selected products, goods and related services, as well as to pay for them and have them delivered or performed. If necessary for the execution of an order, we use service providers, in particular postal, forwarding and shipping companies, to carry out the delivery or performance for our customers. For the processing of payment transactions, we use the services of banks and payment service providers. The required information is marked as such in the course of the ordering or comparable purchasing process and includes the information required for delivery, provision and invoicing as well as contact information in order to be able to consult with customers if necessary; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • Events: We process the data of the participants in the events and similar activities offered or organised by us (hereinafter uniformly referred to as “participants” and “events”) in order to enable them to participate in the events and to make use of the services or activities associated with participation. If we process health-related data, religious, political or other special categories of data in this context, this is done within the scope of obviousness (e.g. at thematically oriented events) or serves health care or safety, or is done with the consent of the data subjects. The required information is marked as such in the course of the commissioning, ordering or comparable conclusion of a contract and includes the information required for the provision of services and invoicing as well as contact information in order to be able to consult if necessary. Insofar as we obtain access to information of end customers, employees or other persons, we process it in accordance with the legal and contractual requirements; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).

Payment procedures

In the context of contractual and other legal relationships, due to legal obligations or otherwise on the basis of our legitimate interests, we offer data subjects efficient and secure payment options and use other service providers in addition to banks and credit institutions for this purpose (collectively “payment service providers”).

The data processed by the payment service providers includes inventory data, such as name and address, bank data, such as account numbers or credit card numbers, passwords, TANs and checksums, as well as contract, amount and recipient-related information. The information is required to carry out the transactions. However, the data entered is only processed and stored by the payment service providers. This means that we do not receive any account- or credit-card-related information, but only information confirming or declining the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. The purpose of this transmission is to check identity and creditworthiness. Please refer to the terms and conditions and the privacy notices of the payment service providers.

Payment transactions are subject to the terms and conditions and privacy notices of the respective payment service providers, which can be accessed on the respective websites or transaction applications. We also refer to these for further information and for the assertion of withdrawal, information and other data subject rights.

  • Types of data processed: Inventory data (e.g. names, addresses); payment data (e.g. bank details, invoices, payment history); contract data (e.g. subject matter of the contract, term, customer category); usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Customers; prospective customers.

Provision of the online offer and web hosting

We process users’ data in order to be able to provide them with our online services. For this purpose, we process the user’s IP address, which is necessary to transmit the content and functions of our online services to the user’s browser or end device.

  • Types of data processed: Usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses); content data (e.g. entries in online forms).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Provision of our online offer and user-friendliness; information technology infrastructure (operation and provision of information systems and technical devices (computers, servers, etc.)); security measures.
  • Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).

Further information on processing operations, procedures and services:

  • Provision of the online offer on our own/dedicated server hardware: To provide our online offer, we use server hardware operated by us as well as the associated storage space, computing capacity and software; legal bases: legitimate interests (Art. 6(1)(f) GDPR).
  • Collection of access data and log files: Access to our online offer is logged in the form of so-called “server log files”. Server log files may include the address and name of the web pages and files accessed, date and time of access, data volumes transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page) and, as a rule, IP addresses and the requesting provider. Server log files can be used for security purposes, e.g. to avoid overloading the servers (especially in the event of abusive attacks, so-called DDoS attacks), and to ensure the utilisation and stability of the servers; Legal bases: Legitimate interests (Art. 6(1)(f) GDPR); Deletion of data: Log file information is stored for a maximum of 30 days and then deleted or anonymised. Data whose further retention is necessary for evidentiary purposes is excluded from deletion until the respective incident has been finally clarified.
  • Email sending and hosting: The web hosting services we use also include sending, receiving and storing emails. For these purposes, the addresses of recipients and senders as well as other information relating to the sending of emails (e.g. the providers involved) and the content of the respective emails are processed. The aforementioned data may also be processed for the purpose of detecting SPAM. Please note that emails on the internet are generally not sent in encrypted form. As a rule, emails are encrypted in transit, but (unless so-called end-to-end encryption is used) not on the servers from which they are sent and received. We therefore cannot accept any responsibility for the transmission path of emails between the sender and receipt on our server; Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).
  • Content delivery network: We use a “content delivery network” (CDN). A CDN is a service that helps deliver the content of an online offer, in particular large media files such as graphics or program scripts, faster and more securely using regionally distributed servers connected via the internet; Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).

Registration, login and user account

Users can create a user account. During registration, users are informed of the required mandatory information, which is processed for the purpose of providing the user account on the basis of the fulfilment of contractual obligations. The data processed includes in particular the login information (username, password and an email address).

When our registration and login functions are used and when the user account is used, we store the IP address and the time of the respective user action. Storage is based on our legitimate interests as well as those of users in protection against misuse and other unauthorised use. In principle, this data is not passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so.

Users may be informed by email about events relevant to their user account, such as technical changes.

  • Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Provision of contractual services and customer service; security measures; managing and responding to enquiries; provision of our online offer and user-friendliness.
  • Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR); legitimate interests (Art. 6(1)(f) GDPR).

Further information on processing operations, procedures and services:

  • Registration with pseudonyms: Users may use pseudonyms instead of their real names as usernames; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).

  • Deletion of data after termination: If users have terminated their user account, their data relating to the user account will be deleted, subject to a legal permission, obligation or the users’ consent; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • No obligation to retain data: It is the users’ responsibility to back up their data before the end of the contract in the event of termination. We are entitled to irretrievably delete all user data stored during the term of the contract; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).

Community functions

The community functions we provide allow users to engage in conversations or otherwise interact with each other. Please note that the community functions may only be used in compliance with the applicable law, our terms and guidelines and the rights of other users and third parties.

  • Types of data processed: Usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Provision of contractual services and customer service; security measures.
  • Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).

Further information on processing operations, procedures and services:

  • Post visibility settings: Users can use settings to determine the extent to which the posts and content they create are visible or accessible to the public or only to certain persons or groups; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • Storage of data for security purposes: Users’ posts and other entries are processed for the purposes of the community and conversation functions and, subject to legal obligations or legal permission, are not disclosed to third parties. An obligation to disclose may arise in particular in the case of unlawful posts for the purpose of legal prosecution. Please note that, in addition to the content of the posts, their time and the users’ IP address are also stored. This is done in order to be able to take appropriate measures to protect other users and the community; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • Right to delete content and information: Posts, content or information of users may be deleted to the extent necessary after a proper weighing of interests if there are specific indications that they constitute a violation of legal rules, our requirements or the rights of third parties; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • Limited deletion of conversation posts: Out of consideration for other users, the user’s conversation posts remain stored even after termination and account deletion, so that conversations, comments, advice or similar communication between users do not lose or reverse their meaning. Usernames are deleted or pseudonymised unless they were already pseudonyms. Users can request the complete deletion of their conversation posts from us at any time; Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).
  • Protection of your own data: Users decide for themselves what data they disclose about themselves within our online offer, for example when they provide information about themselves or take part in conversations. We ask users to protect their data and to publish personal data only with care and only to the extent necessary. In particular, we ask users to note that they must take special care to protect their access data and use secure passwords (i.e. above all, combinations of characters that are as long and random as possible); Legal bases: Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR).

Blogs and publication media

We use blogs or comparable means of online communication and publication (hereinafter “publication medium”). Readers’ data is processed for the purposes of the publication medium only to the extent necessary for its presentation and for communication between authors and readers or for security reasons. For the rest, we refer to the information on the processing of visitors to our publication medium within the framework of this privacy policy.

  • Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Provision of contractual services and customer service; feedback (e.g. collecting feedback via online form); provision of our online offer and user-friendliness; contact requests and communication; managing and responding to enquiries; security measures.
  • Legal bases: Legitimate interests (Art. 6(1)(f) GDPR); consent (Art. 6(1)(a) GDPR).

Further information on processing operations, procedures and services:

  • Comments and posts: When users leave comments or other posts, their IP addresses may be stored on the basis of our legitimate interests. This is done for our security in case someone leaves unlawful content in comments and posts (insults, prohibited political propaganda, etc.). In this case, we ourselves may be held liable for the comment or post and are therefore interested in the identity of the author. Furthermore, we reserve the right to process users’ information for the purpose of spam detection on the basis of our legitimate interests. On the same legal basis, in the case of surveys, we reserve the right to store users’ IP addresses for their duration and to use cookies to prevent multiple voting. The personal information provided in comments and posts, any contact and website information and the content itself are stored by us permanently until the user objects; Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).
  • Comment subscriptions: Users can subscribe to follow-up comments with their consent. Users receive a confirmation email to check whether they are the owner of the email address entered. Users can unsubscribe from ongoing comment subscriptions at any time. The confirmation email will contain information on the options for withdrawal. For the purpose of proving users’ consent, we store the time of registration together with the users’ IP address and delete this information when users unsubscribe. You can cancel the receipt of our subscription at any time, i.e. withdraw your consent. We may store unsubscribed email addresses for up to three years on the basis of our legitimate interests before deleting them in order to be able to prove consent previously given. The processing of this data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that the former existence of consent is confirmed at the same time; Legal bases: Consent (Art. 6(1)(a) GDPR).

Contact and enquiry management

When you contact us (e.g. by contact form, email, telephone or via social media) and in the context of existing user and business relationships, the information provided by the enquirers is processed to the extent necessary to respond to the contact requests and any requested measures.

We use software services accessible via the internet and executed on the servers of their providers (so-called “cloud services”, also referred to as “software as a service”) for the storage and management of content (e.g. document storage and management, exchange of documents, content and information with certain recipients or publication of content and information).

In this context, personal data may be processed and stored on the providers’ servers insofar as it forms part of communication processes with us or is otherwise processed by us as set out in this privacy policy. This data may include in particular master data and contact data of users, data on transactions, contracts, other processes and their content. The providers of the cloud services also process usage data and metadata, which they use for security purposes and to optimise their services.

If we use cloud services to provide forms or other documents and content for other users or publicly accessible websites, the providers may store cookies on users’ devices for web analysis purposes or to remember users’ settings (e.g. in the case of media control).

  • Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Customers; employees (e.g. staff, applicants, former employees); prospective customers; communication partners.
  • Purposes of processing: Office and organisational procedures; information technology infrastructure (operation and provision of information systems and technical devices (computers, servers, etc.)).
  • Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).

Newsletters and electronic notifications

We send newsletters, emails and other electronic notifications (hereinafter “newsletters”) only with the consent of the recipients or a legal permission. If the contents of the newsletter are specifically described when registering for it, they are decisive for the users’ consent. In addition, our newsletters contain information about our services and about us.

To subscribe to our newsletters, it is generally sufficient to provide your email address. However, we may ask you to provide a name so that we can address you personally in the newsletter, or other information if this is necessary for the purposes of the newsletter.

Double opt-in procedure: Registration for our newsletter generally takes place in a so-called double opt-in procedure. This means that after registering you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can register with someone else’s email address. Registrations for the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored with the mailing service provider are also logged.

Deletion and restriction of processing: We may store unsubscribed email addresses for up to three years on the basis of our legitimate interests before deleting them in order to be able to prove consent previously given. The processing of this data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that the former existence of consent is confirmed at the same time. In the case of obligations to permanently observe objections, we reserve the right to store the email address solely for this purpose in a blocklist.

The registration procedure is logged on the basis of our legitimate interests for the purpose of proving that it was carried out properly. If we commission a service provider to send emails, this is done on the basis of our legitimate interests in an efficient and secure mailing system.

Content:

Information about us, our services, promotions and offers.

  • Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); meta and communication data (e.g. device information, IP addresses); usage data (e.g. websites visited, interest in content, access times).
  • Data subjects: Communication partners.
  • Purposes of processing: Direct marketing (e.g. by email or post); reach measurement (e.g. access statistics, recognition of returning visitors).
  • Legal bases: Consent (Art. 6(1)(a) GDPR).
  • Option to object (opt-out): You can cancel the receipt of our newsletter at any time, i.e. withdraw your consent or object to further receipt. You will find a link to cancel the newsletter at the end of each newsletter, or you can use one of the contact options given above, preferably email.

Further information on processing operations, procedures and services:

  • Measurement of open and click rates: The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from our server when the newsletter is opened or, if we use a mailing service provider, from its server. During this retrieval, technical information such as information about the browser and your system, as well as your IP address and the time of retrieval, are initially collected. This information is used for the technical improvement of our newsletter on the basis of the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined using the IP address) or access times. This analysis also includes determining whether the newsletters are opened, when they are opened and which links are clicked. This information is assigned to the individual newsletter recipients and stored in their profiles until they are deleted. The evaluations help us to recognise the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users. The measurement of open and click rates, the storage of the measurement results in the users’ profiles and their further processing are based on the users’ consent. Unfortunately, it is not possible to withdraw consent to performance measurement separately; in this case, the entire newsletter subscription must be cancelled or objected to. In this case, the stored profile information will be deleted; Legal bases: Consent (Art. 6(1)(a) GDPR).
  • Brevo (formerly SendinBlue): Email marketing platform; Service provider: Brevo, 106 boulevard Haussmann, 75008 Paris, France;
    Legal bases: Consent (Art. 6(1)(a) GDPR); Website: https://app.brevo.com/;

Web analysis, monitoring and optimisation

Web analysis (also referred to as “reach measurement”) serves to evaluate the flow of visitors to our online offer and may include behaviour, interests or demographic information about visitors, such as age or gender, as pseudonymous values. With the help of reach analysis, we can, for example, recognise at what time our online offer or its functions or content are used most frequently or invite re-use. We can also determine which areas need to be optimised.

In addition to web analysis, we may also use test procedures, e.g. to test and optimise different versions of our online offer or its components.

Unless otherwise stated below, profiles, i.e. data combined for a usage process, may be created for these purposes and information may be stored in and read from a browser or end device. The information collected includes in particular websites visited and elements used there as well as technical information such as the browser used, the computer system used and information on usage times. If users have consented to the collection of their location data by us or by the providers of the services we use, location data may also be processed.

Users’ IP addresses are also stored. However, we use an IP masking procedure (i.e. pseudonymisation by shortening the IP address) to protect users. In general, no clear data of users (such as email addresses or names) is stored in the context of web analysis, A/B testing and optimisation, but pseudonyms. This means that neither we nor the providers of the software used know the actual identity of users, but only the information stored in their profiles for the purposes of the respective procedures.

  • Types of data processed: Usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Reach measurement (e.g. access statistics, recognition of returning visitors); profiles with user-related information (creating user profiles).
  • Security measures: IP masking (pseudonymisation of the IP address).

Further information on processing operations, procedures and services:

Presences on social networks (social media)

We maintain online presences within social networks and process user data in this context in order to communicate with the users active there or to offer information about us.

Please note that user data may be processed outside the European Union. This may result in risks for users, for example because it could make it more difficult to enforce users’ rights.

Furthermore, user data within social networks is generally processed for market research and advertising purposes. For example, usage profiles can be created based on users’ usage behaviour and resulting interests. These usage profiles can in turn be used, for example, to place advertisements within and outside the networks that presumably correspond to the interests of the users. For these purposes, cookies are usually stored on users’ computers in which their usage behaviour and interests are stored. Furthermore, data may also be stored in the usage profiles independently of the devices used by the users (especially if the users are members of the respective platforms and are logged in to them).

For a detailed description of the respective forms of processing and the options to object (opt-out), please refer to the privacy policies and information provided by the operators of the respective networks.

In the case of requests for information and the assertion of data subject rights, we would also like to point out that these can be asserted most effectively with the providers. Only the providers have access to users’ data and can take appropriate measures and provide information directly. Should you nevertheless need help, you can contact us.

  • Types of data processed: Contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Contact requests and communication; feedback (e.g. collecting feedback via online form); marketing.

As explained in the Facebook Data Policy under “How do we use this information?”, Facebook also collects and uses information to provide analytics services, so-called “Page Insights”, to page operators so that they can gain insights into how people interact with their pages and with the content associated with them. We have concluded a special agreement with Facebook (“Information about Page Insights”, https://www.facebook.com/legal/terms/page_controller_addendum), which regulates in particular which security measures Facebook must observe and in which Facebook has agreed to fulfil the rights of data subjects (i.e. users can, for example, send requests for information or deletion directly to Facebook). The rights of users (in particular to information, deletion, objection and complaint to the competent supervisory authority) are not restricted by the agreements with Facebook. Plugins and embedded functions and content

We integrate functional and content elements into our online offer that are obtained from the servers of their respective providers (hereinafter referred to as “third-party providers”). These may be, for example, graphics, videos or city maps (hereinafter uniformly referred to as “content”).

Integration always requires that the third-party providers of this content process the IP address of users, as without the IP address they would not be able to send the content to their browser. The IP address is therefore required to display this content or these functions. We endeavour to use only content whose respective providers use the IP address solely to deliver the content. Third-party providers may also use so-called pixel tags (invisible graphics, also referred to as “web beacons”) for statistical or marketing purposes. “Pixel tags” can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user’s device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our online offer, and may also be linked to such information from other sources.

  • Types of data processed: Usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses); inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms).
  • Data subjects: Users (e.g. website visitors, users of online services).

  • Shariff: We use the privacy-friendly “Shariff” buttons. “Shariff” was developed to enable more privacy on the internet and to replace the usual “share” buttons of social networks. It is not the user’s browser but the server on which this online offer is located that establishes a connection with the server of the respective social media platform and queries, for example, the number of likes. The user remains anonymous. Cancellation: If you cancel via our “Cancel contracts here” form, we process your details (name, email address, contract, type and date of cancellation, reason if given) in order to process the cancellation and to prove its receipt.

Storage period: We store account data for the duration of the membership. After the membership ends, the account is deactivated; we keep usage data for up to one year and then delete the account, unless you request deletion earlier. We keep payment and invoice data in accordance with the retention obligations under commercial and tax law (usually 8 to 10 years). We keep cancellation notices and their confirmations until the statutory limitation period has expired (usually 3 years from the end of the year).

Changes to and updates of this privacy policy

We ask you to inform yourself regularly about the content of our privacy policy. We will adapt the privacy policy as soon as changes in the data processing we carry out make this necessary. We will inform you as soon as the changes require an act of cooperation on your part (e.g. consent) or other individual notification.

Where we provide addresses and contact information of companies and organisations in this privacy policy, please note that addresses may change over time and please check the information before contacting them.

Rights of data subjects

As a data subject, you have various rights under the GDPR, which arise in particular from Art. 15 to 21 GDPR:

  • Right to object: You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Art. 6(1)(e) or (f) GDPR; this also applies to profiling based on these provisions. Where personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing.
  • Right to withdraw consent: You have the right to withdraw consent you have given at any time.
  • Right of access: You have the right to request confirmation as to whether data concerning you is being processed and to access this data, as well as to further information and a copy of the data in accordance with the legal requirements.
  • Right to rectification: In accordance with the legal requirements, you have the right to request the completion of data concerning you or the rectification of inaccurate data concerning you.
  • Right to erasure and restriction of processing: In accordance with the legal requirements, you have the right to request that data concerning you be erased without delay or, alternatively, in accordance with the legal requirements, to request restriction of the processing of the data.
  • Right to data portability: You have the right to receive data concerning you that you have provided to us in a structured, commonly used and machine-readable format in accordance with the legal requirements, or to request its transmission to another controller.
  • Complaint to a supervisory authority: In accordance with the legal requirements and without prejudice to any other administrative or judicial remedy, you also have the right to lodge a complaint with a data protection supervisory authority, in particular a supervisory authority in the member state of your habitual residence, your place of work or the place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR.

Definitions

This section provides an overview of the terms used in this privacy policy. Many of the terms are taken from the law and are defined above all in Art. 4 GDPR. The legal definitions are binding. The following explanations, on the other hand, are primarily intended to aid understanding. The terms are sorted alphabetically.

  • Conversion measurement: Conversion measurement (also referred to as “visit action evaluation”) is a procedure used to determine the effectiveness of marketing measures. For this purpose, a cookie is usually stored on users’ devices within the websites on which the marketing measures take place and then retrieved again on the target website. For example, this allows us to track whether the advertisements we have placed on other websites were successful.
  • Personal data: “Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Profiles with user-related information: The processing of “profiles with user-related information”, or “profiles” for short, includes any form of automated processing of personal data consisting of the use of such personal data to analyse, evaluate or predict certain personal aspects relating to a natural person (depending on the type of profiling, this may include various information concerning demographics, behaviour and interests, such as interaction with websites and their content, etc.) (e.g. interests in certain content or products, click behaviour on a website or location). Cookies and web beacons are often used for profiling purposes.
  • Reach measurement: Reach measurement (also referred to as web analytics) serves to evaluate the flow of visitors to an online offer and may include the behaviour or interests of visitors in certain information, such as website content. With the help of reach analysis, website owners can, for example, recognise at what time visitors visit their website and what content they are interested in. This allows them, for example, to better adapt the content of the website to the needs of their visitors. For reach analysis purposes, pseudonymous cookies and web beacons are often used to recognise returning visitors and thus obtain more precise analyses of the use of an online offer.
  • Controller: “Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
  • Processing: “Processing” means any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers practically any handling of data, be it collection, evaluation, storage, transmission or deletion.
